Arlene K. Kline focuses her practice on litigation and counseling in labor and employment matters and the public accommodation provisions of the Americans with Disabilities Act. She provides services to clients, ranging from the development and enforcement of personnel policies and procedures to conducting FLSA audits and addressing misclassification issues. She has handled appeals on both the state and federal levels, including a successful argument in the United States Court of Appeals for the Eleventh Circuit in a precedent-setting ADA matter, in which the ruling was adopted by the Supreme Court of the United States in a subsequent case. Her litigation experience includes defending clients in state and federal court, as well as at the administrative level, under Title VII, Section 1981, Section 1983, the FLSA, the ADA, the FMLA, the ADEA, the PDA and the Florida Civil Rights Act. Ms. Kline has also handled litigation regarding Florida’s restrictions on unfair competition and use of trade secrets.

Professional Experience |
- Advise a national client base on labor and employment law matters, including benefits/compensation, discrimination, termination of employment, employment contracts (negotiations and drafting) and restrictive covenants.
- Advise a national client base on ADA compliance in places of public accommodation, representation in litigation over ADA non-compliance, including defense of nationwide class actions.
- Represent clients and reply to charges before state and federal administrative agencies, including the Equal Employment Opportunity Commission, the Florida Commission on Human Relations, local EEO agencies, the Department of Labor and the Unemployment Compensation Appeals Board.
- Draft, review and propose policy and procedural changes to employee handbooks, drug-free workplace policiesdocument retention policies and various other personnel policies.
- Conduct internal investigations in employment discrimination matters and Department of Labor audits.
- Conduct internal audits of client’s workforce for wage and hour law compliance.
- Advise clients on federal contractor requirements and OFCCP compliance.
- Counsel clients on departmental restructuring and reductions in force.
- Author sexual harassment and discrimination training materials for clients.
